How Islamic inheritance (wirasat) is divided
- Funeral expenses are paid first from the estate.
- Debts are paid next, including a wife’s unpaid mehr, which is a debt on the husband’s estate.
- Wasiyyat (will): up to one-third of what remains, and not in favour of a legal heir unless the other heirs agree.
- The rest is divided among the heirs by the shares fixed in the Quran (Surah An-Nisa 4:11, 4:12, 4:176).
Fixed shares at a glance
| Heir | Share |
|---|---|
| Husband | 1/2 if no children; 1/4 if there are children or grandchildren |
| Wife (or wives together) | 1/4 if no children; 1/8 if there are children or grandchildren |
| Sons and daughters | Share the remainder; each son gets twice a daughter’s share |
| Daughters only (no son) | One daughter 1/2; two or more share 2/3 |
| Father | 1/6 if there is a son; 1/6 plus remainder if only daughters; whole remainder if no children |
| Mother | 1/6 if there are children or two or more siblings; otherwise 1/3 |
| Full sisters (no brother, children or father) | One 1/2; two or more 2/3; with daughters they take the remainder |
| Maternal half-siblings | One 1/6; two or more share 1/3 equally (male and female equal) |
| Grandmother(s) | 1/6 if the mother is not alive |
Key rules the calculator applies
- Hajb (blocking): closer relatives block more distant ones. A son blocks grandchildren and all siblings; the father blocks the grandfather and all siblings; the mother blocks both grandmothers.
- Awl: if the fixed shares add up to more than the whole estate, all shares are reduced proportionally.
- Radd: if something is left and there is no residuary heir, it is returned to the blood relatives in proportion to their shares. The spouse does not receive radd.
- Orphaned grandchildren (Pakistan law): under Section 4 of the Muslim Family Laws Ordinance 1961, if a son or daughter died before the deceased, their children receive the share the parent would have received. Enter them under “Sons/Daughters who died before, leaving children”.
Worked example
A man leaves Rs 1 crore, a wife, his mother, two sons and one daughter. The wife gets 1/8 (Rs 12.5 lakh) and the mother 1/6 (about Rs 16.67 lakh). The remaining 17/24 (about Rs 70.83 lakh) is split into five parts: each son gets two parts (about Rs 28.33 lakh) and the daughter one part (about Rs 14.17 lakh).
After the shares are worked out: the legal process in Pakistan
- Succession certificate / letter of administration: apply at a NADRA Succession Facilitation Unit (where available) or the civil court, to transfer bank accounts, shares and property.
- Property mutation (inteqal): the land record office (Patwari or the Arazi Record Centre in Punjab) transfers land to the heirs according to their shares.
- Women’s share: denying a woman her inheritance is illegal. Women can complain under the Enforcement of Women’s Property Rights Act, including to the Ombudsperson.
Frequently asked questions
Why does a son get double the daughter’s share?
The Quran (4:11) sets this ratio. Traditionally a man carries the duty to pay mehr and to support his wife, children and dependent relatives, while a woman’s share is entirely her own.
Do grandchildren inherit if their father died before the grandfather?
In Pakistan, yes. Section 4 of the Muslim Family Laws Ordinance 1961 gives them the share their parent would have received.
Do brothers and sisters inherit if there is a son?
No. A son, a son’s son, or the father blocks all brothers and sisters.
Is this calculator valid for Shia (Jafari) inheritance?
No. This calculator follows Hanafi fiqh, which most Pakistani Muslims follow and courts apply to Sunni families. Jafari rules differ (for example, the order of heirs and radd to the spouse). Consult a qualified scholar for Shia inheritance.
Can a parent give everything to one child by will?
No. A will (wasiyyat) cannot exceed one-third of the estate and cannot favour a legal heir without the consent of the other heirs. Gifts (hiba) made during life follow different rules.
This calculator gives an estimate for guidance and is not a fatwa or legal advice. Complex cases (missing persons, unborn children, multiple deaths at once, disputed relationships, distant relatives) need a qualified mufti or lawyer.
